When businesses or individuals are unable to pay their bills, financial obligations can be adjusted to allow for continued business operation. Ms. Ebner represents both debtors and creditors in this process and has significant experience in representing such parties with either bankruptcy tools, out of court restructuring agreements, Assignments for the Benefit of Creditors, or simple common sense and credibility.

The restructure or liquidation of business debt through either federal bankruptcy intervention or out of court restructuring.

Preferential Transfer Defense
In certain situations where bankruptcy "Debtors" have paid creditors for amounts that were due them on "old bills", these creditors can be sued for a return of the payment. Ms. Ebner represents these creditors.

Medical Practice Bankruptcy Reorganization
The past many years have shown an increase in jury awards in excess of the insurance policy limits of Illinois physicians. These judgments can cause personal financial catastrophe to the physician against whom the judgment is entered. Ms. Ebner has successfully represented such physicians in resolving, whether by negotiation or litigation, these excess judgments both with and without the need for bankruptcy intervention.

Chapter 11 - Corporations, Partnerships and individuals
Chapter 11 is a bankruptcy tool generally used by an individual or business for the purpose of restructuring its debt to enable it to remain in operation. Ms. Ebner represents "Debtors" who need such relief, "creditors" who are owed money from such debtors, and individuals and businesses seeking to remove collateral or purchase assets from these bankruptcy estates.

Collection of Judgments in Bankruptcy
Upon the filing of every bankruptcy case, creditors of the bankrupt debtor are generally "stayed" from continuing to collect amounts due them. Ms. Ebner represents such creditors, and applies exceptions to the right to collect, asserts priority positions for repayment of debt, and aggressively asserts the rights of the creditor in order to maximize its recovery.

Divorce/Bankruptcy Issues
Whether used as a "tool", or whether merely an unfortunate result of domestic disturbance, divorce frequently creates financial problems. Ms. Ebner has had particular success in representing both men and women in seeking to preserve (or nullify) rights to property settlement awards, and child support and maintenance rights that were awarded by a matrimonial litigant.
